The District of Columbia government takes drunk driving cases very seriously.  In the Summer of 2012, the District government passed the Comprehensive Impaired Driving and Alcohol Testing Program Emergency Amendment Act of 2012.  This legislation drastically altered the penalties for drunk driving cases in the District.

The law provides for MANDATORY minimum jail sentences for first time offenders in certain circumstances.  For those individuals with a BAC of higher than .20 a 10 day jail sentence is required.  A Judge has no choice but to impose that jail sentence.  The sentence cannot be served on the weekends and must be served consecutively.  For a BAC higher than .25 a 15 day mandatory jail sentence is imposed.   In addition to the mandatory jail time, first time offenders can receive up to a $1,000 fine and $250 in court costs.  

For those individuals with prior drunk driving offenses the penalties are even greater.  A 10 day mandatory minimum sentence is imposed for a second offense and 15 days mandatory jail time for a third offense.  In addition, the maximum penalties increase for repeat offenders.  The maximum jail sentence increases from 180 days to 1 year in jail and the maximum fine increases from $1,000 to $5,000.
