Washington, DC Felony Assault on a Police Officer While Armed Charge REDUCED

A Farrelly PC client facing a charge of Felony Assault on a Police Officer While Armed had his charges reduced to misdemeanor Simple Assault and misdemeanor Assault on a Police Officer.  Client was given a sentence of time served in jail (65 days) with no additional jail time or probation.

Felony Assault on a Police Officer While Armed is charged under DC Code 405 (c) and carries a maximum penalty of 30 years in jail and/or a $75,000 fine.  In addition, under the Voluntary Sentencing Guidelines, the offense requires a minimum of 3 years incarceration, regardless of the facts of the case or criminal history of the defendant.

DUI/DWI Charge DISMISSED in Washington, DC

DUI/DWI charge filed against Farrelly PC client in Washington, DC Superior Court dismissed pursuant to a diversion agreement with the government.  Driving Under the Influence is charged under DC Code Section 50-2206.11 and carries a maximum penalty of 180 days in jail and/or a $1,000 fine in addition to a potential 6 or 12 month driver's license suspension.

Washington, DC No Permit Charges DISMISSED

A Farrelly PC client charged with driving without a valid permit in Washington, DC Superior Court has charges dismissed.  Driving without a valid permit is charged under D.C. Code Section 50-1401.01 (d) and carries a maximum penalty of 90 days in jail or a $500 fine.

Farrelly PC Client Has Second Offense DUI/DWI Charge REDUCED

A Farrelly PC client facing Second Offense DUI/DWI charge enters plea to the reduced charge of DUI First Offense.  Had the government convicted the Farrelly PC client of the original charges the client faced maximum penalties of 1 year in jail and/or a $5,000 fine.  Further, the client faced a MANDATORY MINIMUM sentence of 10 days in jail.  Under the reduced conviction to DUI First Offense, client received zero days of jail and a period of probation.

Washington, DC Assault With Intent to Kill While Armed Charge DISMISSED

After nine months of government investigation, Farrelly PC client has charge of assault with intent to kill while armed dismissed.  Assault with intent to kill while armed, or "AWIK" while armed, is charged under DC Code Sections 22-401 & 4502 and carries a maximum sentence of 30 years in jail and/or a $75,000 fine.  If an individual is convicted of AWIK while armed, even with no prior criminal record, he or she faces a jail sentence of 7.5-15 years according to the Voluntary Sentencing Guidelines.  Further, no matter what the circumstances, AWIK while armed carries a MANDATORY MINIMUM jail sentence of 5 years.

Washington, DC Assault and Attempted Possession of a Prohibited Weapon Charges DISMISSED

One count of simple assault and one count of attempted possession of a prohibited weapon filed in Washington, DC Superior Court dismissed on the day of trial.  Simple assault is charged under DC Code Section 22-404 and carries a maximum penalty of 180 days in jail and/or a $1,000 fine.  Attempted Possession of a Prohibited Weapon is charged under DC Code Sections 22-4514(b) and 1803 and also carries a maximum penalty of 180 days in jail and/or a $1,000 fine.

Operating After Revocation charge filed against Farrelly PC client in Washington, DC Superior Court dismissed pursuant to diversion agreement with the government.  Operating After Revocation, charged under DC Code Section 50-1403.01 (e), although a "traffic" offense, is a misdemeanor crime and carries a maximum penalty of 1 year in jail.
