Washington, DC Bail Reform Act Charge DISMISSED

Farrelly PC client facing one count of sexual solicitation and one count of bail reform act  violation (failing to appear in court) had the bail reform act violation charge dismissed pursuant to plea agreement.  The client received a sentence of 30 days with credit for time served with no additional probation or jail time.  

The bail reform act charge carried a maximum penalty of 180 days in jail and a mandatory penalty of 90 days in jail that must run consecutive to any other sentence in addition to a potential $1,000 fine.

Possession of a Prohibited Weapon Charges in Washington, DC DISMISSED

A Farrelly PC client facing a domestic violence charge of Possession of a Prohibited Weapon had his case dismissed on the day of trial by a DC Superior Court Judge.  The client faced a maximum penalty of 180 days in jail and/or a $1,000 fine if he had been convicted.

Washington, DC Assault Charges DISMISSED After Successful Completion of Diversion

A Farrelly PC client had her assault charge dismissed after successfully completing Mental Health Court diversion.  The client was facing a maximum penalty of 180 days in jail and/or a $1,000 fine if convicted of simple assault.  The client spent four months participating in DC Superior Court Mental Health Court attending various counseling programs and remaining illegal substance free.  In exchange the government dismissed her case upon completion of the program.

Second Degree Theft Charges DISMISSED in Washington, DC

A Farrelly PC client had his Second Degree Theft Charges dismissed by the court on the day of trial.  The client faced a maximum penalty of 180 days in jail and/or a $1,000 fine if convicted.  The client had his charges dismissed after successful completion of a Deferred Prosecution Agreement, which is a type of diversion.

Washington, DC Felony Robbery Charge REDUCED

A Farrelly PC client facing Robbery charges had those charges reduced to Attempt Robbery and received a sentence of probation pursuant to a plea agreement with the government.  The maximum penalty for Robbery is 15 years in prison and/or a $37,500 fine.  The maximum penalty for Attempt Robbery is 3 years in prison and/or a $12,500 fine.  In addition, the client was sentenced pursuant to the DC Youth Rehabilitation Act, which will allow for the entire record of the case to be sealed upon successful completion of probation.

Farrelly PC client has one count of second degree theft, one count of receipt of stolen property and one count of unlawful entry filed in Washington, DC Superior Court dismissed pursuant to a diversion agreement.  All three counts carry a maximum penalty of 180 days in jail and/or a $1,000 fine.

Washington, DC Felony Assault on a Police Officer While Armed Charge REDUCED

A Farrelly PC client facing a charge of Felony Assault on a Police Officer While Armed had his charges reduced to misdemeanor Simple Assault and misdemeanor Assault on a Police Officer.  Client was given a sentence of time served in jail (65 days) with no additional jail time or probation.

Felony Assault on a Police Officer While Armed is charged under DC Code 405 (c) and carries a maximum penalty of 30 years in jail and/or a $75,000 fine.  In addition, under the Voluntary Sentencing Guidelines, the offense requires a minimum of 3 years incarceration, regardless of the facts of the case or criminal history of the defendant.
